If you are interested in an out-of-state relocation or in-state move, you have to demonstrate to the court that it is in the best interest of your children. The court will look at a number of factors as they try to understand the reason for your move and how it will impact the lives of your children, including:

  • Why are you relocating?
  • Do you have a job lined up in your new potential home?
  • Will there be a support network for the children in the new location?
  • Have you lost your job in your current location?

Some relocation cases are relatively simple. If the non-custodial parent fails to pay support or has a problem with drugs or alcohol, and the custodial parent provides constant support, but has to move for job-related reasons, it is clearly in the best interest of all parties involved for parental relocation to be granted.

In most cases, however, the non-custodial parent is living up to their end of the bargain, making relocation much more difficult.
